With its judgment in SRB, the ECJ has created a paradox in EU data protection law: data may be both personal and non-personal at the same time. This may be reminiscent of a thought experiment widely known as Schroedinger’s cat. However, unlike the hypothetical cat, the data in the pseudonymisation box is both personal and non-personal, depending on who’s looking at the box. For the controller, i.e. the entity determining the purposes and means of the processing, who has the additional information that allow them to open the box, the data is personal.
