I am hoping to get some feedback on how to address a situation that occurred recently.
I have a severe peanut allergy. I go to asian restaurant pretty often, mostly chinese and Japanese. I order food via uber eats from Ho ho cherry. I ordered Mongolian beef. The description for the food does not suggest or indicate that there are peanuts in the food AT ALL. Like, there are other food items that list if they have peanut sauce in them like the lo mein, but the Mongolia beef doesnt.
Anyway, when placing the order, I used Ubers allergy request feature. I was clicking through a bunch of food items, not getting a bunch of stuff but sorta browsing. When I placed the order, I assumed that the allergy request was still attached to the...

Well, found out shortly after eating the Mongolian beef that there is actually a peanut sauce/ingredient that is used in the recipe. I had to take an epi pen and get rushed to the ER as a result. Smh
Upon talking with uber eats and ho ho cherry management, I learned that the allergy request was never sent, so they didnt know that I had a food allergy. However, I am off the position that I ordered a food item that stated no ingredients for peanuts or whatever for some reason. When talking with management, they basically said they dont include it on the menu because its a small portion of the ingredients used to make the meal...
Idk, but that feels insane to me. I asked explicitly if they felt that they didnt need to put peanut allergies on the food item and they were saying that EVERYONE that comes through gives their allergies, so they never had this issue before. Basically, they would rather be reactionary rather than proactive, because its "up to the customer to notify them of allergies" for a food item that I never had with peanuts anywhere else.
Is there anything I can do? I understand I have some blame because I failed to make sure that the food allergy was listed. But it feels extremely upsetting that I selected a food item that had no indications of having nuts, after browsing the menu and seeing other items have "peanut sauce" listed, and being told ho ho cherry that its my job to make sure I'm safe.
I know north carolina has strict laws in regards to negligence...but im a student and paying for an ER bill and trying to buy a new epi pen, on top of not getting a refund just feels so wrong. Hoping to get insights from others on what I could do.
A few notes: 1. I recognize i have responsibility in this. But I have had Mongolian beef several times and never had a reaction. 2. It feels all the risk is being put on me and none of the blame on the restaurant for not including peanuts on the item description, but they do for everything else.
