A serial flytipper who advertised his services and was paid to remove household and building waste from people’s houses dumped the rubbish despite being made subject to a suspended prison sentence. He carried on illegally dumping waste but was discovered after one of his customers’ details was traced from the fly-tipped rubbish.
Stewart Evans, 41, was made subject to a criminal behaviour order for 10 years after he was convicted of 12 counts of fly-tipping between 2023 and 2024. He was prohibited from removing waste from the home of any person in exchange for payment.
He was also convicted of fly tipping offences in 2022, which led to him losing his waste carriers licence. For the latest court reports sign up to our crime newsletter.
A sentencing hearing at Newport Crown Court on Wednesday heard the defendant was also prohibited from advertising his services for waste removal.
Despite this, he continued to advertise waste removal services on Facebook, but changed the profile in order to target different areas.
Following an investigation by Newport Council’s waste enforcement team, Evans was found to have fly-tipped a large amount of rubbish in Gaer Vale, Newport, which linked back to one of the defendant’s customers.
Prosecutor Lee Reylonds said the defendant had also committed two other fly-tipping offences, which put him in breach of the criminal behaviour order.
At the time of his previous sentencing hearing in 2024, the court heard Evans fly-tipped in 12 separate locations in Gwent and left items including a fridge and furniture in public spaces having been paid cash in hand. He would trawl social media for people looking to dispose of waste and would contact them, claiming he was offering a legitimate service.
He was sentenced to 30 weeks imprisonment suspended for 18 months. He was also ordered to carry out a 30-day rehabilitation activity requirement and 120 hours unpaid work.
Evans, of Castle Street, Caerleon, pleaded guilty to three counts of fly-tipping and breaching a criminal behaviour order.
In mitigation, Kevin Seal said his client was in ill health and had klinefelter syndrome. He described the defendant as going through turmoil in terms of his accommodation.
Judge Richard Kember sentenced Evans to a total of 15 months imprisonment.
Following the hearing, Councillor Yvonne Forsey, cabinet member for climate change, waste and recycling at Newport Council said: “I’m delighted with the custodial sentence handed to Stewart Evans.
“Time and time again, Evans has flagrantly flouted the law. And every time he has, the hard work of our waste enforcement team has ensured that he has been brought to justice.
“This is a fantastic outcome which sends a strong message to fly-tippers that when we have sufficient evidence, we will come after you and stop you treating our city as your personal dumping ground.”
