Amy Coney Barrett is many things: a Supreme Court Justice who’s said she has no idea what a constitutional crisis would look like; an alleged member of a Christian cult accused of sex abuse and homophobia; a former judge who said that requiring funerals for fetuses was totally fine.
But is Amy Coney Barrett a feminist? I’d rather wrap strings around my teeth and tie the ends to a runaway train than have to consider this question—but Barrett has seemingly declared conservative law students our society’s ultimate feminists for rejecting liberal snowflake beliefs like women having a choice in their reproductive healthcare, so here we are.
On Thursday night, the Federalist Society held its annual gala in Washington, D.C., where Barrett appeared alongside the Court’s resident frat bro, Justice Brett Kavanaugh. The far-right organization is a circle jerk of conservative and libertarian lawyers and law students who—in the same breath—will argue that states should ban abortion but also claim they’re of superior intelligence because they believe in small government. If you tell them they sound like a pretentious toddler who thinks they’re being clever by asking for a glass of water to delay bedtime, they’ll call you emotional. Six of our nine current Supreme Court justices are, or have been, affiliated with the Federalist Society.
“In truth, being a conservative woman in law school, particularly, takes a lot of courage and independence, and in many ways, shows more feminism than just falling into some predetermined vision of what a woman should be,” Barrett said. “I admire your courage for facing that.” Sure.
“You can’t take an oath to the Constitution if you’re not willing to sacrifice,” she said at another point while talking about the abortion rights protesters outside her home after she voted to** overturn Roe v.Wade**. The sacrifice here being…an obstructed view of her suburban street?
I’m sure the women who’ve suffered from sepsis, who were instructed to bleed out in a parking lot, or who’ve lost their fertility or, in some cases, their lives, because their states banned abortion after Roe, which resulted in urgent or life-saving care being delayed, would get a kick out of hearing that.
“I think that all women should feel free to truly choose whatever it is they want,” Barrett added. “Whether it is to be conservative or to be liberal, or to have large families, to not get married – whatever it may be.”

Of course, I believe this as well. The most basic definition of feminism is that a woman should have the freedom to choose however she wants to live her life. As a mother of seven and a Supreme Court Justice, Barrett certainly embodies that ideal, and has generations of feminist leaders to thank for her personal and professional achievements. After all, it takes a lot of progress to be able to serve on the nation’s top court and remain an alleged active member of a religious community that sees women as subordinate. Yet, her defining SCOTUS achievement to date has been overturning *Roe—*a decision that decimated healthcare for millions and took away that choice from other women.
So…are conservative law students feminists because they’re willing to argue against women’s rights? I don’t know—are female serial killers feminists because they only kill other women? I suppose these are the questions fifth-wave feminism will have to face.
